These Terms of Service govern your use of SalesLeak and the services provided by SalesLeak (“SalesLeak”, “we”, “us”, or “our”).
By creating an account, installing a SalesLeak integration, or using our services, you agree to these Terms.
1. What SalesLeak Does
SalesLeak is an ecommerce intelligence platform designed to help merchants identify buying frictions, uncover revenue leakage and understand why shoppers leave without purchasing.
SalesLeak may provide functionality through:
- Website integrations
- Embedded widgets
- Shopify applications
- WooCommerce plugins
- WordPress plugins
- APIs and future integrations
SalesLeak collects and analyses shopper interactions and responses to provide insights, reporting, recommendations and related services.
2. Eligibility and Accounts
You must be at least 18 years old to use SalesLeak.
You agree to:
- Provide accurate account information
- Keep login credentials secure
- Maintain accurate billing information
- Use the platform in compliance with applicable laws
You are responsible for all activity occurring under your account.
3. Free Trials
SalesLeak may offer free trials, promotional access or limited free plans from time to time.
Unless otherwise stated:
- Free trials do not require a credit card
- Trial access may be limited
- Features may change at any time
- Trial accounts may be suspended or terminated at our discretion
At the end of a trial period, certain functionality may be restricted until a paid subscription is activated.
4. Paid Plans and Billing
Paid subscriptions are billed on a recurring basis.
By subscribing, you authorise us and our payment processor to charge applicable fees.
Unless otherwise stated:
- Charges are billed in advance
- Upgrades may take effect immediately
- Downgrades may take effect at the next billing cycle
- Taxes may apply depending on your location
All payments are processed by Stripe or another authorised payment provider.
SalesLeak does not store full payment card details.
5. Usage Limits
Certain plans may include limits relating to:
- Responses collected
- Data storage
- Active widgets
- Integrations
- Features or usage levels
If applicable, SalesLeak may:
- Notify you when approaching plan limits
- Restrict functionality
- Pause certain features
- Offer plan upgrades
SalesLeak reserves the right to modify plan limits and pricing with reasonable notice.
6. Cancellation and Account Termination
You may cancel your subscription at any time.
Unless otherwise stated:
- Access continues until the end of the current billing period
- Refunds are not provided for partial billing periods
- Data retention follows the policies described in our Privacy Policy
SalesLeak may suspend or terminate accounts that violate these Terms or create risk to the platform, other users or third parties.
7. Merchant Responsibilities
You are responsible for ensuring that your use of SalesLeak complies with applicable laws and regulations.
This includes:
- Providing appropriate privacy notices
- Obtaining required consents
- Complying with privacy and data protection laws
- Complying with Shopify, WooCommerce, WordPress and other platform requirements
- Ensuring the legality of information collected through your implementation of SalesLeak
8. Shopper Data and Data Processing
For shopper information collected through merchant websites, SalesLeak acts as a Data Processor on behalf of the merchant.
The merchant remains responsible for determining the legal basis for collecting and processing shopper information.
SalesLeak processes such information solely to provide its services.
9. Acceptable Use
You agree not to:
- Violate any law or regulation
- Use SalesLeak for fraudulent, harmful or deceptive purposes
- Attempt to gain unauthorised access to the platform
- Reverse engineer, copy or reproduce the platform
- Resell or sublicense SalesLeak without written permission
- Interfere with platform security or performance
- Use SalesLeak in a manner that may damage the platform or its users
10. Service Availability
SalesLeak aims to provide reliable service but does not guarantee uninterrupted or error-free operation.
Features may be modified, updated, suspended or discontinued at any time.
Scheduled maintenance, technical issues or third-party service interruptions may affect availability.
11. Intellectual Property
SalesLeak and its licensors retain all rights, title and interest in:
- Software
- Technology
- Branding
- Documentation
- Designs
- Reports and platform content
You retain ownership of data collected through your use of SalesLeak.
You grant SalesLeak the rights necessary to process such data in order to provide the service.
12. Disclaimer of Warranties
SalesLeak is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, SalesLeak disclaims all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law:
- SalesLeak shall not be liable for indirect, incidental, special, consequential or punitive damages.
- SalesLeak shall not be liable for loss of profits, revenue, business opportunities, goodwill or data.
- SalesLeak shall not be liable for decisions made based on platform recommendations, analytics or AI-generated outputs.
SalesLeak’s total aggregate liability arising from any claim shall not exceed the total amount paid by you to SalesLeak during the three (3) months immediately preceding the event giving rise to the claim.
14. Changes to These Terms
We may update these Terms from time to time.
Material changes may be communicated through email, platform notifications or updates posted on our website.
Continued use of SalesLeak after changes become effective constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of Singapore.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
